The Tenth Judicial District Court convened Tuesday, November 29 with Judge Thomas Stockard presiding.
Trey Ayard Wilson-Landis, in custody, appeared for arraignment on a Category D Felony of Possession of a Controlled Substance for the Purpose of Sales which is punishable by 1-4 years in Nevada State Prison and a fine of up to $5,000. The defendant pled guilty and was sentenced to 12-32 months in Nevada State Prison to run concurrent to the sentence he is currently serving. Fines and fees were imposed.
Zackary Michael Franco, in custody, pled guilty to Accessory to Battery Causing Substantial Bodily Harm, a Category C Felony. Franco was sentenced to 16-48 months in Nevada State Prison, to run concurrently with his current incarceration sentence.
Robert Mark Havens appeared for a Status Hearing regarding a Category D Felony of Burglary of a Structure, and a Category E Felony of Attempt to Commit Grand Larceny of Personal Goods or Property. Havens was sentenced to 19-48 months in Nevada State Prison on each charge, to run consecutively for an aggregate sentence of 38-96 months. The sentence was suspended. The defendant was placed on probation with conditions attached. Fines and fees were imposed.
Angelica Leticia Lopez-Rickards appeared for a Review Hearing. In this court on November 1, the judge ordered Lopez-Rickards to complete a competency evaluation. Public Defender Wright Noel told the court that the evaluation has not been done and asked for 4 more weeks for the defendant to comply. ADA Priscilla Baker pointed out that “this has been going on since May, trying to get these evaluations done and it’s just excuse after excuse.” The state asked for remand to custody. The judge told Lopez-Rickards that she has a residential phone line, a cell phone, and a phone at work. He ordered her to call Noel’s office every Thursday at 9 a.m. Noel was ordered to call the doctors and set up 2 evaluations by Thursday and have his staff notify Lopez-Rickards of the days and times. A Review Hearing was set for January 3, 2023.
Kyle Gary Fuller pled not guilty to a charge of Attempt to Commit Grand Larceny of Personal Goods or Property, which can be sentenced as a Category E Felony or as a Gross Misdemeanor. ADA Chelsea Sanford said that due to the not-guilty plea the state will be filing amended information with the two 2 counts. Count 1, Grand Larceny of a Property or Goods, a Category D Felony, and Count 2, Conspiracy to Commit Grand Larceny of Property or Goods, a Gross Misdemeanor. Trial was set for June 21- 23, 2023.
Arthur Tomkins Locke McNeely pled guilty to a Gross Misdemeanor of Conspiracy to Commit Issuance of a Check or Draft Without Sufficient Money or Credit. Matthew Louie, General Manager of Louie’s Home Center, made a victim statement. He said, “We’re not big people. Our employees are paid directly out of what you rake from us.” He said if that can be the one thing taken away, “that is my goal in sitting here.” The defendant was ordered to pay fines, fees, and restitution of $2,240.04 for two generators fraudulently purchased from Louie’s Home Center and sentenced to 364 days in the Churchill County Jail, suspended and placed on probation with conditions attached.
Kellsie Lynn Barry appeared for sentencing on two Category D Felony counts of Making, Uttering, or Possessing with the Intent to Utter Fictitious Bill, Note, or Check. ADA Baker explained Barry stole mail from mailboxes to find checks made out to credit card companies, wash the checks, put her name on them, and cash them to support her drug problem. Baker said there were 6 victims. Court-appointed attorney Benjamin Gaumond told the court Barry has been doing a lot better lately, she is employed and attending counseling. He said she “is not just regretful, she is genuinely remorseful.” Barry apologized and said she “would like the opportunity to show that I can move forward.” The judge imposed fines and fees; ordered restitution in the amount of $4,880.27 to the victims at a minimum of $300 a month; and sentenced Barry to 19-48 months on each charge for an aggregate total of 38-96 months in Nevada State Prison, suspended. The defendant was placed on probation with conditions attached.
Chester Edwin Anderson-Madewell appeared for sentencing on a Category C Felony of Offer, Attempt, or Commission of an Unauthorized Act Relating to a Controlled or Counterfeit Substance. ADA Chelsea Sanford stated, “Drugs are the scourge of our community and here in front of you today is a dealer of that scourge, methamphetamine.” The state asked for a sentence of 12-34 months in Nevada State Prison. Public Defender Wright Noel stated the defendant is gainfully employed and is supervisable. He asked for probation and drug court for the defendant. Anderson-Madewell was ordered to pay restitution in the amount of $380 to the North Central Task Force, fines and fees were imposed, and he was sentenced to 12-32 months in Nevada State Prison and remanded to the custody of the Sheriff for imposition of the sentence.
