The Tenth Judicial District Court convened Tuesday, November 15th with Judge Thomas Stockard presiding.
Jason James Teeter appeared for a Status Hearing. On October 18 he pled not guilty to charges of Possession of a Controlled Substance, a Category E, and Manufacture, Duplication, Possession, or Use of a Deadly Weapon or Silencer, Carrying a Concealed Weapon without a Permit, a Category C Felony, carrying penalties for the Category E felony of 1-4 years in prison and $5,000 in fines and the Category C 1-5 years and $10,000 in fines. The state and the defense are prepared to go to trial on November 30. Jury selection will ensue.
Scott Michael Barela failed to appear for arraignment and a Bench Warrant, $25,000 cash only, was issued.
Jessica Kay Collins pled guilty to a charge of Offer, Attempt, or Commission of an Unauthorized Act relating to the Manufacture or Compounding of Certain Controlled Substance, 1st offense, a Category C Felony which carries a possible penalty of 1-5 years in Nevada State Prison and a fine of up to $10,000. A Pre-sentence Investigative Report was ordered, and sentencing was set for February 7, 2023.
Brandon Heleodoro Rodriguez-Sigala pled guilty to a charge of Possession of a Controlled Substance (9.1 grams of cocaine) 1st or 2nd offense, a Category E Felony which is punishable by 1-4 years in Nevada State Prison, and a fine of up to $5,000. The judge sentenced Rodriguez-Sigala to 12-32 months, suspended, and placed him on probation with conditions attached. Fines and fees were applied.
John Gregory Bracken pled guilty to a charge of Possession of a Controlled Substance (methamphetamine) 1st or 2nd offense, a Category E Felony which carries a potential penalty of 1-4 years in Nevada State Prison and a fine of up to $5,000. Bracken received a suspended sentence of 12-32 months in Nevada State Prison and was placed on probation with conditions attached. Fines and fees were applied.
Kimberly Ann Sanchez appeared for sentencing on a charge of Possession of a Controlled Substance, a Category E Felony which carries a possible penalty of 1-4 years in Nevada State Prison and a fine of up to $5,000. She was sentenced to 12-32 months in Nevada State Prison, suspended, and placed on probation with conditions attached. Fines and fees were imposed.
Rebecca Lynn Welch appeared for sentencing on a charge of Offer, Attempt, or Commission of an Unauthorized Act Relating to the Manufacture or Compounding of Certain Controlled Substance. Welch was sentenced to 19-48 months in Nevada State Prison, suspended, and placed on probation with conditions attached. Fines and fees were imposed.
Mary Jane Baltazar was sentenced on a Gross Misdemeanor charge of Abuse, Neglect, or Endangerment of a Child Not Causing Substantial Bodily or Mental Harm, which carries a potential penalty of 364 days in the Churchill County Jail and a fine of up to $2,000. ADA Priscilla Baker stated the defendant drank alcohol and got behind the wheel of an automobile with her 7-month-old infant in the car; the infant was not strapped in the car seat. Baker told the Court that Baltazar put society and her infant in danger as she crossed into the center lane multiple times. Public Defender Jacob Sommer said Baltazar is remorseful and knows her actions are not acceptable. Baltazar received a sentence of 364 days, suspended. She was placed on probation and ordered to get a substance abuse evaluation and a mental health evaluation along with other conditions attached. Fines and fees were imposed.
Larry Dewayne Becknell, in custody, was arraigned on 1 - Burglary of a Structure, a Category D Felony which carries a possible penalty of 1-4 years in Nevada State Prison, 2 - a Gross Misdemeanor Charge of Conspiracy to Commit Grand Larceny of a Motor Vehicle which carries a possible penalty of 364 days in the Churchill County Jail, 3- Buying, Possessing, Receiving, or Withholding Stolen Property of a Value of $1,200 to $5,000, a Category D Felony which carries a potential penalty of 1-4 years, and 4 - Being an Ex-felon in Possession of a Firearm or a Deadly Weapon, a Category B Felony punishable by a possible 1-6 years. Becknell pled guilty to all 4 charges. The judge discussed with Becknell that he has charges pending in Washoe County on which he will be sentenced Thursday. Public Defender Charles Woodman told the court that as part of plea negotiations a couple of charges were dropped and a Category C Felony was dropped to a Gross Misdemeanor. Sentencing was set for December 13 to allow for both victim notification and Washoe County sentencing.
Brady James Drayton, in custody. ADA Chelsea Sanford requested counsel approach the bench to discuss the results of the plea bargaining and negotiations. Afterward, the judge announced that along with other matters, there is one victim in one of the cases that the judge's family has an interest in. Therefore, he will enter an order of recusal and ask that the case be heard Friday by Judge Shirley.
Justin David Carter, in custody, pled guilty to a charge of Possession of a Controlled Substance 1st or 2nd offense, a Category E Felony which carries a potential penalty of 1-4 years in Nevada State Prison and a fine of up to $5,000. Carter also admitted to a non-technical probation violation of failure to complete treatment and absconding. For the felony, Carter received a sentence of 12-32 months in Nevada State Prison, suspended, and placed on probation for up to 18 months with the usual conditions applied. On the probation violation, Carter's probation was revoked, and he was remanded to the sheriff’s custody for imposition of sentence. Carter will do his probation on the felony charge while he's in prison and credit was given for 156 days time served. Fines and fees were imposed.
Richard Lee Owens, in custody, appeared on a technical violation of failure to complete the Salvation Army Program. Public Defender Woodman told the court Owen will admit his error and asks for another chance with the Salvation Army. ADA Priscilla Baker told the Court, “He asked for the Salvation Army. He knew that that's what was on the line, and this is his conduct.” The judge temporarily revoked probation and gave Owens 30 days. Owens was ordered to remain in custody until he is accepted back into the Salvation Army program.
Ashley Christina Day, in custody, admitted to a non-technical probation violation of failure to complete the Western Regional Drug Court program. ADA Baker asked for revocation explaining the defendant has been given chances and asked that the underlying sentence be imposed. Public Defender Sommer told the court that his client is struggling with drug addiction, she has an interview with Step 2, and she has a support system, she is not a lost cause. The judge modified the sentence to 18-60 months in Nevada State Prison. Day was given credit for 43 days time served and remanded to the custody of the Sheriff for imposition of the sentence.
Sandra Winterflower Curtis, in custody, admitted to the non-technical probation violation of failure to successfully complete specialty court. The judge rescinded the Diversion program and sentenced her to 12-32 months in Nevada State Prison, suspended. Curtis was placed on probation with conditions. The Court ordered good time forfeited and credit was given for 44 days time served.
