Darren Shane Frisby pled guilty to a charge of Possession of a Schedule 1 or 2 Controlled Substance for the Purpose of Sales, a Category D Felony which carries a potential penalty of 1-4 years and a $5,000 fine. Stockard ordered a Pre-sentence Investigative Report, sentencing was set for January 31, 2023.
 

Rudolfo Ortiz pled guilty to Possession of a Controlled Substance 1st or 2nd offense, a Category D Felony which carries a potential penalty of 1-4 years and a $5,000 fine. Ortiz received a sentence of 1-4 years which was suspended, he was placed on probation for 12 months with conditions attached, ordered to pay fines and fees.
 

Noah Chase Krogg was found guilty on a charge of Statutory Sexual Seduction, a Gross Misdemeanor. ADA Priscilla Baker asked for the full sentence of 364 days in the Churchill County Jail saying Krogg took trust and power from the victim when he took advantage of her. Defense Attorney Thomas Viloria asked the court to sentence Krogg to probation. Viloria described Krogg as "caring, kind, considerate, industrious, and hard-working." Krogg stated he learned a lot through his counseling sessions and assured the court, "I can guarantee you will never see me in this courtroom again." He was sentenced to 364 days; the sentence was suspended. Krogg was placed on probation for 12 months, with the continuation of sexual offender treatment throughout his probation period, he must register as a sex offender, perform 100 hours of community service in the next 10 months, and pay fees, and fines.
Audrey Camille Ottesen appeared on charges of driving while intoxicated and speeding. The judge ordered a Status Hearing for May 16, 2023. Ottesen told the court she could pay $4,000 in fines within the next six months.

 

Susan Elaine Tybo appeared for sentencing on a charge of Offer, Attempt, or Commission of an Unauthorized Act relating to Manufacture or Compounding of Certain Controlled Substance. Defense Attorney Wright Noel stated Tybo has had 150 days of sobriety. Tybo told the court she is trying to change not just for herself but for her daughter. Tybo received a sentence of 24-60 months in Nevada State Prison, suspended. She was placed on probation with conditions and ordered to pay fines and fees.
 

Timothy Robert Smith, in custody, was sentenced to 12-36 months in Nevada State Prison on a charge of Possession of a Controlled Substance. He was remanded to the custody of the sheriff for the execution of his sentence.
 

Christopher William McCann, in custody, was sentenced to 24-60 months in Nevada State Prison for Possession of a Stolen Motor Vehicle. McCann was remanded to the custody of the Sheriff for the execution of the sentence.
 

Diane Penelope Matehuala-Sandoval pled guilty to a charge of Abuse, Neglect, or Endangerment of a Child not Causing Substantial Bodily Harm, a Gross Misdemeanor that carries a potential penalty of 364 days in the Churchill County Jail and a fine of up to $2,000. A sentencing hearing was set for January 3, 2023.
 

Kenneth Berry Dennison appeared for sentencing on a charge of Attempt to Commit Battery to Cause Substantial Bodily Harm which can be sentenced as a Gross Misdemeanor or as a Felony at the judge's discretion. ADA Chelsea Sanford told the court that pursuant to negotiations the state is remaining silent on this case. Defense Attorney Steve Evenson produced Dennison's employer and his father as character witnesses. The employer stated Dennison is a very caring person who is very reliable, always willing to help, and whose absence would put a burden on the establishment. His father told the Court Dennison had "never been any problem, never been any trouble" before this incident. Evenson implored the judge to sentence this as a Gross Misdemeanor and grant Dennison the privilege of probation. Dennison told the Court he takes full responsibility for his actions of which he gave a brief recap, and said he hopes the judge will go with a Gross Misdemeanor. Noting Dennison's "complete lack of criminal history " and his work history, Stockard did find Dennison guilty of a Gross Misdemeanor and sentenced him to 364 days in the Churchill County Jail, suspended, and a fine of $2,000 which is to be paid at a rate of $250 a month within the first 8 months of probation. Dennison was also ordered to have no firearms in his possession throughout his period of probation.
 

Troy Michaels Jock was not present for sentencing. Defense Attorney Evenson explained to the court that Jock is in custody in Winnemucca on multiple charges. Stockard issued a warrant with a $25,000 cash-only bond. A Status hearing was set for January 10. 2023.
 

Jesse Calvin Gilbert, in custody, appeared for sentencing on a charge of Being a Felon in possession of a firearm. Defense Attorney Evenson asked the court for a continuance, which was denied. ADA Sanford stated, "At this point, the state believes the best predictor of the defendant is his past behaviors. His past behaviors paint a dangerous picture." Sanford told the court that in the past 16 years Gilbert has had 3 drug dealing convictions and 16 misdemeanors which involve violence. She said the PSI reveals Gilbert has "never been successful on probation. Never been successful on parole." Sanford requested 24-72 months in the Nevada Department of Corrections saying, "This defendant is a menace to our community who makes poor decisions. And now he has a firearm." Evenson requested Gilbert be placed on probation, stating, "I am imploring the court to continue on the path it was on with Jesse of making sure he has the opportunity to demonstrate who he actually is and what he's actually capable of." Gilbert told the Court he is remorseful for everything he has done and that he is not the monster the DA says he is. Gilbert was sentenced to 16-54 months in the Nevada State Prison and remanded to the custody of the sheriff for the execution of sentence.
