On Monday, February 28, alongside her attorney Ken Lyon Esq., and her court-certified interpreter Maria Davis, Ofelia Murillo stood for sentencing before the Tenth Judicial District Court with Judge Jim C. Shirley presiding. Shirley, currently the Eleventh Judicial District Court Judge in Lander County, sat in for Churchill County Judge Thomas Stockard, who recused himself from the matter, citing a conflict of interest.
Murillo was initially charged with one count of Open Murder, expressly, First Degree Murder, potentially punishable by the death penalty. Court documents alleged that she "willfully, unlawfully, and with express or implied malice aforethought, deliberation, and premeditation, murdered Cesar Alvarado," by shooting him with a 9mm handgun. In addition to murder, Murillo faced other serious felony charges relating to the fatal shooting. Last November, she finally pled guilty to (1) Principal Voluntary Manslaughter, with the Use of a Deadly Weapon, with a firearms enhancement. Murillo also pled guilty to the first offense Grand Larceny of a Motor Vehicle.
Judge Shirly sentenced Murillo to 4-10 years in prison for Principal to Murder with an additional 4-10 years for the deadly weapon's enhancement and 2-5 years for grand larceny of a vehicle.
