Justice Court News Dec. 21

The New River Justice Court convened Tuesday, December 21, 2021, with Judge Benjamin Trotter presiding.  

Nichola Ulibarri-Farris (in custody) appeared on a speeding violation. According to the allegations, on December 17, Nichola was going approximately 75 mph in a 60-mph speed zone on Highway 50 near Lucas Road. He was arrested and kept in custody on an open warrant out of another jurisdiction. Nichola pled guilty and will remain in custody pending transfer.  

Adam Jay Eisenhauer (in custody), 33, was present for a status hearing. He was arraigned in Justice Court on Thursday, December 16, after being arrested on December 14 on multiple charges related to the Sexual Assault of a Child Under the Age of 14. According to Assistant District Attorney Jeffery Weed, four of the ten alleged counts include Lewdness with a Child Under the Age of 14. They are Class A Felonies that carry life in prison with the possibility of parole after ten years. Further, there are additional and ongoing alleged child abuse/endangerment charges with the victim, who is now 11, claiming that these acts have been going on for 3-4 years. Jacob Sommer, Churchill County Public Defender, assigned to represent Eisenhauer, addressed his client’s custodial status and requested a release on his Own Recognizance (OR) or a bail reduction. Judge Trotter denied the OR request, reduced Eisenhauer’s bail to $50,000 bondable, and scheduled a status hearing for January 13. 

Alicia Joann Cabrera (in custody) appeared for a status hearing on two charges: (1) Destroy or Injure Real Property of Another with a value of $250-5,000, a Gross Misdemeanor punishable by up to 364 days in jail, and (2) Burglary.  

According to CCPD Noel, Cabrera has several Failure-to-Appear charges in her criminal history; however, they are all related to traffic offenses. He also stated that she cares for her ailing mother and her three children. ADA Weed noted that Cabrera also has concerning convictions in her past, including theft of a firearm, burglary, and violent offenses. Additionally, she has more recent charges that include theft and drug-related offenses in other Nevada jurisdictions. Judge Trotter denied Noel’s request for his client’s OR release and stated that it has taken the Court 18 months to catch up with her to resolve this case. He increased the bail to $10,000 bondable from the existing $5,000 cash-only amount. A status hearing was scheduled for January 13, 2022. 

James Edward O’Brien (in custody) appeared for a status hearing on a charge of Battery which Constitutes Domestic Violence on a Pregnant Victim, a first offense. The charge is a misdemeanor punishable by two days to six months in jail, provided the crime involves no deadly weapons, strangulation, or serious injuries. Churchill County Public Defender Wright Noel argued for O’Brien to be released on his Own Recognizance (OR). Despite the argument against his release by ADA Baker, Judge Trotter granted the OR release and scheduled a preliminary hearing for January 13.
