The Tenth Judicial District convened Tuesday, October 12, with Judge Tom Stockard presiding.
Trever James Nady was arraigned on Injury to Property charges, with damages that range from $250-$5,000, a gross misdemeanor punishable by up to 364 days in jail. Per the terms of negotiations with the State, Nady entered a guilty plea. According to Charles Woodman, Esq., defense counsel for Nady, the allegations state that between January 1 to January 4 of this year, his client broke the windows of three different vehicles within Churchill County. Additionally, Nady has unrelated charges pending in Justice Court. Sentencing was postponed until December 7 in order to resolve the Justice Court case first.
Sergio Bravo (in custody) appeared for sentencing on a charge of Possession of Controlled Substance, a Category E Felony that can carry 1-4 years in prison. According to Assistant District Attorney Chelsea Sanford, Bravo’s criminal history precludes him from automatically receiving mandatory probation. At the time of his arrest, Bravo had 119 oxycodone pills on his person. Sanford requested the Court impose a sentence of 12-32 months in prison. Wright Noel, Public Defender for Bravo, stated that Bravo demonstrated a long break from criminal activity, and the pills were for personal use. Additionally, there was no indication that his client was selling the drugs, despite the quantity in his possession. Bravo received probation on a suspended sentence of 12-32 months in prison with credit for time served in the Churchill County Jail.
Maria Elana Nunez (in custody) appeared on a probation violation. According to ADA Sanford, Nunez relapsed a month after completing Specialty Court on an underlying DUI charge and was subsequently arrested for a second offense DUI. The hearing was continued for one week, pending clarification of her probation status in Washoe County, and Nunez was released on her own recognizance.
Richard Cory Plummer (in custody) appeared for a probation violation. Plummer admitted to failing to comply with the terms of his probation. According to ADA Sanford, Plummer was also removed from Drug Court and was recently convicted for drug paraphernalia use or possession in Washoe County and has at least two other prior felonies. Sanford requested that the Court revoke Plummer’s probation and sentence him to 12-32 months in prison. Plummer addressed the Court, saying, “After months of being in a transitional living house in Reno, I wasn’t really ready. I know that I need residential treatment. I know I am an addict, but I don’t want to do drugs anymore.” He then explained that he was mugged, beaten, and lost his phone while in Reno, which was partially responsible for his removal from Drug Court. In response, Judge Stockard stated, “If you think that being mugged and losing your phone is the reason you were kicked out of Drug Court, then you are really out of touch with the reality of your situation.” Sentencing was set for January 4.
