Last week’s article Pot, Guns, and Money – New Laws from the 81st Legislature requires a bit of clarification regarding the new legalization of cannabis consumption lounges in Nevada. Thanks for the heads-up from a couple of our readers.
The article stated that “Nevada residents age 21 or older may consume marijuana within prescribed and state-approved cannabis lounges. However, as recreational marijuana is not legal in Churchill County, residents should not expect any cannabis lounges within county or city limits". The statement should have read that the sale of recreational marijuana is not permitted in Churchill County. And, as cannabis lounges will most certainly be selling their products to patrons, locals should not expect any lounges to open within the county.
One reader wrote in providing additional information: "1) There are no recreational dispensaries because our county commission voted a permanent ban on them. 2) You cannot grow plants if you live within 25 miles of the one medical dispensary in Fallon per Nevada law. [Our former sheriff and the current judge advised the commission to allow the one medical dispensary to prevent residents from growing marijuana plants here.] 3) You can buy it for recreational use at a legal dispensary in another county and use it only at your own residence (must have landlord approval to use it there if you don’t own the property)."
Both the City of Fallon and Churchill County officials voted to disallow recreational dispensaries in the area, prior and thus far stand by their decision to permit only one medical marijuana dispensary. According to Nevada law, six plants may be grown for personal use (maximum of 12 plants per household) if the grower lives more than 25 miles from the nearest licensed dispensary. Our reader is also correct in stating that if you are using marijuana in a home you rent or lease, you need to obtain permission from the owner. Residential owners may prohibit marijuana on their own property.
It is illegal to:
Cross a state line with marijuana, nor can you take it on an airplane
Mail marijuana products out of state
Purchase marijuana from a street dealer in any county in Nevada
Grow more than 12 plants – doing so is a felony
Using marijuana in public, including casinos and hotel rooms, office buildings, bars, restaurants, stadiums, public restrooms, etc., or on federal property.
Smoke pot in public - it is a misdemeanor that carries a fine of up to $600
A few notes:
Medical marijuana patients can have no more than 2.5 ounces of useable medical marijuana every 14 days or more than 12 plants for medical purposes
Adults 21 and older can possess up to one ounce of marijuana or 1/8 ounce of cannabis concentrate
On October 1, public consumption of marijuana will then be permitted in “social use venues”
It is still illegal under federal law, to use street drugs like cocaine, heroin, and methamphetamines
