Dana Patricia Benka plead guilty on charges of allegedly allowing a child to be present during the commission of certain violations that involve controlled substances and for attempting to commit an act relating to the manufacturing of a controlled substance. According to Charles Woodman Esq., defense counsel for Benka, on June 26th, she allowed her two-year-old daughter to be present while selling approximately 3.5 grams of methamphetamines. Both charges are Category B felonies which carry potentials penalties of 1-5 years in prison each. Benka will remain in the custody of Churchill County jail until she appears for sentencing on October 13th.

 

Michael Orlando Cagle was arraigned on charges of alleged possession of a schedule 1 or 2 controlled substance for the purpose of sale (a first offense) and for having an explosive or incendiary device in or near certain public or private areas. Both charges carry penalties of 1-4 years in prison. According to Woodman, also defending Cagle, the allegations state that on September 11th Cagle did possess methamphetamines for the purpose of sale as well as an incendiary device with a gunpowder base. Cagle, a California resident, entered a guilty plea on both counts and will appear for sentencing on January 5th, 2021.

 

Isabelle Corwin did not appear for a scheduled arraignment on a Class B felony. for two consecutive weeks. A Failure to Appear (FTA) warrant was issued with a no-bail hold.

 

Benka, Cagle, and Corwin were all arrested by the North Central Narcotic Task Force.

 

James Eric Koltz appeared for sentencing on charges of grand larceny of a firearm, a Category B felony. According to Charles Woodman, Esq, defense for Koltz, he did steal a gun and a chainsaw from his former employer after being unable to return to work during the COVID-19 shutdown. Koltz received probation on a suspended prison sentence of 24-60 months.

 

Brayden Walker Castillo entered a guilty plea on a single charge of conspiracy to commit grand larceny of a firearm, a gross misdemeanor. According to Woodman, also representing Castillo, the allegations state that his client stole a Glock G-21 handgun from a residence within the city limits while attending a party last May. Per the terms of the plea agreement entered into with the State, Castillo received probation on a suspended sentence of 364 days in the County Jail, 100 hours of community service, and a fine of $1,000.

 

According to Nevada Statute, a person who intentionally steals, takes, and carries away a firearm owned by another person commits grand larceny of a firearm, a Category B felony. The penalty is 1-10 years in prison with up to $10,000 in fines.

 

Jeromy Delvecchio, in the custody of the Churchill County Jail, appeared for sentencing on a probation violation reported. The matter was continued for one week per the request of his defense counsel, Jacob Sommer, Esq.

 

Dalton Lee Drew entered a guilty plea on charges of failure to appear after being released on his own recognizance in 2019, a Category B felony which can carry 1-5 years in prison. He is currently being held in Churchill County Jail after being extradited from Kansas. Drew initially faced charges of allegedly possessing a controlled substance in which probation would have been mandatory. Judge Stockard set bail at $15,000 cash only due to Drew's extensive history of theft crimes as well as eight prior Failure to Appear charges dating back to 2011. Sentencing on both cases is set for November 3rd.

 

Greggory Nash Garcia appeared for sentencing on charges of possessing a firearm as a prohibited person, a Category B felony. According to Assistant District Attorney (ADA), Priscilla Baker, Garcia has a prior domestic battery conviction in Washington as well as a felony larceny conviction, both of which prohibit him from owning or possessing a firearm. Additionally, Garcia is facing a similar charge in Washoe County after law enforcement discovered a firearm in the trunk of the vehicle after he was involved in an automobile accident. According to Sommer, defense counsel for Garcia, no other crimes were committed outside the firearms possession charge. Garcia received probation on a suspended prison sentence of 28-72 months.

 

Steven Wayne Lawrence plead guilty for allegedly violating a temporary court order restricting stalking or harassment, a gross misdemeanor. According to Sommer, defense counsel for Lawrence, his client made contact with a prohibited person listed in a temporary protective order on August 30th. Sentencing is scheduled for October 20th.

 

Jeremiah James Weadock, in the custody of Churchill County Jail, appeared for sentencing on a probation violation. The violation report alleges that Weadock had not been in contact with Parole and Probation since July of 2018 and thereby failed to comply with the reporting, residence, and employment requirements of probation. Weadock turned himself into the Churchill County Sheriff’s office in hopes to resolve the matter. Judge Stockard reinstated his probation with the provision that he complete the Western Nevada Regional Drug Court program.
