Notes from District Court

 

District Court convened Tuesday, July 14th, via conference call and open court, with Judge Tom Stockard presiding.

 

Greggory Nash Garcia entered a guilty plea for possession of a firearm by certain prohibited persons, a Class B felony. According to defense counsel, Jacob Sommer, Esq, Garcia’s original charges date back to November of 2019. Garcia has a prior felony conviction as well as a misdemeanor conviction for domestic violence. Both result in the loss of the right to own or possess a firearm. After the State completes a pre-sentencing investigation (PSI) Garcia will appear for sentencing and is potentially facing 1-6 years in prison.

 

James Eric Koltz was scheduled to be arraigned on alleged charges of grand larceny of a firearm. Defense counsel, Charles Woodman, Esq., requested two-week continuance which was granted.

 

Mitchell Allen Sexton was scheduled to be arraigned and possibly sentenced on charges stemming from a March Task Force arrest for allegedly possessing a controlled substance, possession drug paraphernalia, and possession of a controlled substance for sale. Sexton was granted a two-week continuance.

 

Brittania Sharrie Anderson-Vankrey did not appear for sentencing. A bench warrant was issued, and bail was set at $25,000 cash only.

 

Donnie Roy Johnson entered a guilty plea on a felony DUI charge. Charles Woodman, representing Johnson, argued for probation and entrance into a long term treatment program for Johnson. “I do have a problem with alcohol,” admitted Johnson while addressing the court. Judge Stockard addressed Johnson’s four prior DUI convictions, stating, “A lot of people are alcoholics, but they don’t all get behind the wheel.” Stockard considered giving Johnson the maximum penalty of 72-180 months in prison but handed down a suspended sentence of 32-160. Additionally, Johnson will be required to have an Interlock device installed on his vehicle for the maximum allowed 36 months. An Interlock device is an in-car breathalyzer that prevents drivers from starting their vehicles until the test is taken.

 

Victoria Elizabeth Mattern entered a guilty plea to felony battery, constituting domestic violence. Sentencing is scheduled for August 11, 2020. Mattern has had two previous misdemeanor domestic violence charges within the last two years. All persons convicted of crimes of domestic violence are required to surrender all firearms upon sentencing and lose their right to own or possess firearms.

 

James Michael White entered guilty pleas on two separate counts of assault with a deadly weapon allegedly occurring on March 23 and March 24, 2020 with bodily injury occurring. According to defense counsel, Jacob Sommer, Esq., White’s plea agreement will allow him to enter a long-term treatment program. Upon successful completion of the program, the State agreed to allow his sentences to run concurrently. Each charge carries a potential penalty of 1-6 years in prison with the possibility of enhancements for bodily injury. Should White fail to complete the program successfully, the sentences are to consecutively. In either instance, White must be returned to the custody of the Churchill County Sheriff’s Office to await sentencing. White is also facing three counts of domestic battery in Justice Court.

 

Kevin Andrew Sneed was arraigned on three charges including abuse, neglect, or endangerment of a child, a Category B felony, battery on an officer or other official, and obstructing or resisting arrest. Sneed plead guilty on all counts. Sneed allegedly hit an unnamed 13-year-old in the face in late April. In connection to the incident, Sneed accosted a law enforcement officer and resisted arrest. Judge Stockard deferred sentencing the charges of abuse, neglect, or endangerment and required Sneed to enter and complete the Western Regional Drug Court program successfully.
