Man Pleads Guilty to DUI Causing Death

District Court convened Tuesday, June 9th, via conference call and open court, with Judge Tom Stockard presiding.

After fatally hitting a pedestrian last February, Marcin Adam Bojarski appeared before the court to be arraigned on charges of driving while under the influence, causing death or substantial bodily harm. Marcin was represented by Robert Lindsey, Esq. and plead guilty before Judge Stockard. The alleged Category B felony carries a penalty of  2-20 years in prison and does not allow for a suspended sentence (probation).

According to Lindsey, February 15, 2020 at 7:20 PM, Bojarski was driving in the downtown area of Fallon and accidentally struck and killed a pedestrian near the corner of Williams Avenue and Carson Street. “Mr. Bojarski had small amounts of both alcohol and marijuana in his system,” stated Lindsey.  “A pedestrian wearing a black coat crossed the street in front of him in the crosswalk. Although two vehicles were stopped in the left-hand lane, Bojarski did not see the pedestrian and accidentally struck her causing her death.”

The original arrest reports indicated that Bojarski remained at the scene to talk to the police. He was subsequently arrested on March 3rd.  In his statement to the court, Bojarski expressed his regret stating “It was a complete accident. If I could take it back, I would. I am so sorry for everything.” Bojarski will appear for sentencing on September 1st, 2020 in District Court.

Kevin Andrew Sneed was arraigned on two charges alleging abuse, neglect, or endangerment of a child, a Category B felony and battery on an officer, provider of health care, school bus driver, transit operator or sports official. Sneed was represented by Charles Woodman, Esq. and plead guilty to both counts. According to charges, Sneed allegedly hit an unnamed 13-year-old in the face in late April. In connection to the incident, Sneed accosted a law enforcement officer. A plea memorandum had been negotiated, however Judge Stockard continued the matter for one week to allow the State and defense counsel to finalize the terms of sentencing.

In other matters:

Nicholas Daniel Docherty was arraigned on charges of unlawfully taking a vehicle on March 20th. According to Woodman, also defending Docherty, he mistakenly took the vehicle believing it was the truck that he had been instructed to drive to Fast Glass for repair on behalf of another party. Docherty claimed the keys were in it and it was in the approximate location he was sent to retrieve the vehicle. Docherty was arrested at Fast Glass and later charged. The owners of the vehicle elected not to press charges and presented no victim impact statement to the court. Docherty specifically requested not to be granted probation and was sentenced to 120 days in jail.

Eugene Albert Mauwee was arraigned and plead guilty to a charge of attempting to commit burglary, a Category D Felony carrying a penalty of 1-5 years in prison. Mauwee, also represented by Woodman, admitted to entering Walmart on or about December 14, 2019, with the intent to committing petty larceny. Having two more prior convictions for similar crimes within the last three years, the charge was enhanced resulting in felony burglary.  Mauwee will appear for sentencing on Sept 1st.

Juan Jesus Rangel received probation on a suspended sentence carrying 12-30 months in prison after pleading guilty to possession of a schedule 1 or 2 controlled substance for the purpose of sale. Woodman, Rangel’s public defender, stated that his client cooperated with police during his arrest at the Nugget last January. At that time, Rangel was found with approximately 4 grams of prepackaged methamphetamines in his possession. “Under the new Nevada law, he wouldn’t even be here,” Woodman explained. Woodman was referencing recently passed AB239 which raised the threshold for trafficking to 100 grams of a controlled substance.
